    I move that House Bill 1019 be amended to read as follows:

SOURCE: IC 12-15-2-14.5; (12)MO101902.1. -->     "SECTION 1. IC 12-15-2-14.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2012]: Sec. 14.5. (a) An adoptee (as defined in IC 31-9-2-2) who is less than eighteen (18) years of age is eligible to receive Medicaid if the adoptive parent (as defined by IC 31-9-2-6) is eligible for an adoption subsidy under IC 31-19-26.5, and:
        (1) is not able to provide health insurance for the adoptee; or
        (2) has family health insurance in which the maximum annual or lifetime coverage limit for the adoptee has been reached.
    (b) Before August 1, 2012, the office shall apply to the United States Department of Health and Human Services for any state Medicaid plan amendment or Medicaid waiver necessary to implement this section.

        (1) a child with special needs based on a medical, a physical, a mental, or an emotional condition that existed before the filing of the adoption petition; and
        (2) either:
            (A)
the beneficiary of an agreement for adoption subsidy under this chapter; or
            (B) in compliance with IC 12-15-2-14.5 and is not the beneficiary of, but is otherwise eligible for, an adoption subsidy due to insufficient funds available for an adoption subsidy;
is eligible for Medicaid. ".
