    I move that House Bill 1222 be amended to read as follows:

(a) Except as provided in section 2.5 of this chapter, the bureau shall adopt rules under IC 4-22-2 establishing the requirements to qualify for participation in the special group recognition license plate program.
    (b) Representatives of a special group shall petition the bureau to qualify for participation in the special group recognition license plate program.
    (c) Each petition submitted under this section must contain the printed name, address, and signature of at least five hundred (500) members of the special group who pledge to purchase the special group recognition license plate if a special group recognition license plate is issued for the group under this chapter.
    (d) When a petition containing the information required in subsection (c) is submitted to the bureau, the bureau may design and issue a special group recognition license plate that designates a vehicle as being registered under this chapter by a person (as defined in IC 9-13-2-124) who is a member of the special group.
SOURCE: IC 9-18-25-2.5; (12)MO122203.48. -->     SECTION 48. IC 9-18-25-2.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JANUARY 1, 2012 (RETROACTIVE)]: Sec. 2.5. (a) Beginning January 1, 2012, the bureau may not approve, issue, or

renew a special group recognition license plate issued under this chapter for a special group that encourages, supports, or promotes any of the following:
        (1) Use of illegal drugs.
        (2) Use of tobacco or tobacco products by a minor.
        (3) Sexual activity involving a minor.
        (4) Sexual activity outside of marriage not in accordance with IC 20-30-5-13.
        (5) Use of pornography.
        (6) Abortion.
        (7) Disrespect for parents, the family, religion, healthy behavior, or good citizenship as described in:
            (A) IC 20-30-5-5; or
            (B) IC 20-30-5-6.
        (8) The undermining of the Constitution of the United States or the Constitution of the State of Indiana.
        (9) The:
            (A) undermining of the law; or
            (B) overthrow;
        of the government of the United States.
        (10) A lifestyle that is contrary to:
            (A) IC 20-30-5-13; or
            (B) marriage between one (1) man and one (1) woman.
        (11) The use of alcoholic beverages by an individual less than twenty-one (21) years of age.

     (b) The bureau shall identify each special group that encourages, supports, or promotes any of the subjects set forth in subsection (a) and upon identification shall terminate the special group's eligibility within the special group recognition plate program. Upon termination of the eligibility, the bureau shall demand the return of the special group recognition license plate issued to each recipient of a license plate concerning the terminated special group. Upon return of the terminated special group recognition license plate, the bureau shall refund any:
        (1) annual supplemental fee collected under IC 9-29-5-38(a)(2) or IC 9-29-5-38(d)(3); and
        (2) annual fee collected by the bureau under this article and IC 9-29-5 that has been distributed to any trust fund established under section 17.7 of this chapter;
to the former plateholder.
    (c) The bureau shall:
        (1) afford the former special group recognition plateholder the opportunity to submit an application to purchase another special group recognition license plate; or
        (2) issue a license plate in accordance with IC 9-18-2-30.
