Synopsis: Drug use by TANF recipients. Requires that an application for assistance under the Temporary Assistance for Needy Families program (TANF) must contain a statement to be signed under the penalties of perjury by an individual who will receive TANF assistance that the individual: (1) does not currently use a controlled substance without a valid prescription or order of a practitioner acting in the course of the practitioner's professional practice; and (2) agrees not to use a controlled substance without a valid prescription or order of a practitioner acting in the course of the practitioner's professional practice while the individual is receiving TANF assistance.

    A BILL FOR AN ACT to amend the Indiana Code concerning human services.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 12-14-1-3.5; (12)IN0338.1.1. -->     SECTION 1. IC 12-14-1-3.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2012]: Sec. 3.5. An application for assistance under the TANF program must contain a statement that must be signed under the penalties of perjury by an individual who will receive assistance under the TANF program either on behalf of a dependent child or for the individual. The statement must state that the individual:
        (1) does not currently use a controlled substance (as defined in IC 35-48-1-9) without a valid prescription or order of a practitioner acting in the course of the practitioner's professional practice; and
        (2) agrees not to use a controlled substance (as defined in IC 35-48-1-9):
            (A) without a valid prescription or order of a practitioner acting in the course of the practitioner's professional practice; and
            (B) while the individual is receiving assistance under the

TANF program.
