I move that Engrossed Senate Bill 538 be amended to read as follows:
Delete the title and insert the following:
A BILL FOR AN ACT to amend the Indiana Code concerning
motor vehicles and to make an appropriation.

"SECTION 3. IC 8-2.1-23-1 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 1. The motor carrier
regulation fund is established for the
purpose purposes of:
(1) (A) the administration and enforcement of this article; and
(2) (B) the administration and enforcement of IC 6-6-4.1 and
IC 6-8.1-4-4; and
(2) supplementing the funding of the department of state
revenue in carrying out its powers and duties under IC 9-20.

SECTION 4. IC 8-2.1-23-2 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 2. (a) The treasurer of
state shall deposit:
(1) fees collected under this article, IC 9-20-18-14.5, and
IC 9-29-6-1.5; and
(2) amounts appropriated under section 5 of this chapter;
in the motor carrier regulation fund.
(b) Money in the fund is annually appropriated to the
department of state revenue for its use in carrying out the purposes
of this chapter.

SECTION 5. IC 8-2.1-23-5 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2013]: Sec. 5. (a) Before July 1, 2014, the department of state
revenue shall hire additional inspectors to enforce this article and
IC 9-20. Subject to subsection (b), the number of additional
inspectors hired under this section is left to the discretion of the
department of state revenue.
(b) At least fourteen (14) additional inspectors must be hired
under this section. The number of inspectors hired under this
section must enable the department of state revenue to adequately
staff the permanent weigh stations operated under IC 9-20-17
without reducing the number of roadside inspections conducted
under IC 9-20-17.
(c) There is annually appropriated to the department of state
revenue from the state general fund an amount sufficient to employ
the inspectors hired under this section.".
Renumber all SECTIONS consecutively.
