"SECTION 3. IC 10-13-2-6.5 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2013]: Sec. 6.5. (a) Before July 1, 2014, the
division, under the direction and supervision of the superintendent,
shall institute a centralized crime and delinquency data collection
program that is certified by the Federal Bureau of Investigation.
(b) A data collection program complies with this section if an
application for certification has been submitted to the Federal
Bureau of Investigation before July 1, 2014.
(c) The superintendent shall adopt rules to implement this

SECTION 4. IC 16-19-13-7 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
1, 2013]: Sec. 7. (a) Before July 1, 2014, and at least one (1) time
every two (2) years thereafter, the office or the state department
shall conduct a survey to determine the number of Indiana
residents who have been the victim of a crime of domestic violence
(as defined by IC 35-31.5-2-78) or a sex offense (as defined by
IC 11-8-8-5.2). The survey shall include persons who have been the
victim of a delinquent act that would be a crime of domestic
violence or a sex offense if committed by an adult.
(b) The office or state department may contract with a third
party to conduct the survey described in subsection (a).
(c) Information contained in a survey described in subsection (a)
that identifies or could be used to determine the identity of a
person responding to the survey is confidential. All other
information contained in the survey is not confidential and is
available for inspection and copying under IC 5-14-3.
(d) The state department shall adopt rules under IC 4-22-2 to
implement this section.

SECTION 5. [EFFECTIVE JULY 1, 2013] (a) The general
assembly urges the legislative council to assign to the criminal law
and sentencing policy study committee or another existing study
committee, for study during the 2013 legislative interim, the topic
of the collection of crime and delinquency data. If assigned this
topic, the committee shall consider the extent to which certain
crimes, including crimes of domestic violence and sex crimes, are
underreported to law enforcement.
(b) This SECTION expires November 1, 2013.
