    I move that Engrossed Senate Bill 621 be amended to read as follows:

SOURCE: IC 36-3-7-10; (13)MO062148.11. -->     "SECTION 11. IC 36-3-7-10 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 10. (a) This section applies if the sheriff in a county with a consolidated city incurs an expense that is increased above the ordinary and usual expenses of the sheriff as a result of an action or omission of a member of the police department of the consolidated city occurring after June 30, 2013.
    (b) As used in this section, "police department of a consolidated city" includes a consolidated law enforcement department that is established under this article and under the direction and control of a person other than the elected sheriff of the county in which the consolidated city is located.
    (c) The police department of the consolidated city shall reimburse the sheriff for the additional costs described in subsection (a) not more than thirty (30) days after presentation of a written statement describing the costs to the police chief of the police department. However, the sheriff and the police department may agree to have the notice submitted to the controller of the consolidated city in lieu of presentation to the police chief.
    (d) The police department of the consolidated city and sheriff may enter into an agreement designating the circumstances under which reimbursement will occur or the amounts that will be reimbursed for an act or omission, or both.
    (e) Amounts transferred to the sheriff under this section are available for use by the sheriff upon appropriation by the county fiscal body in a budget or supplemental budget.
