    I move that House Bill 1357 be amended to read as follows:

SOURCE: IC 20-28-8-6; (13)MO135708.7. -->     "SECTION 7. IC 20-28-8-6, AS ADDED BY P.L.1-2005, SECTION 12, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 6. (a) A contract entered into by a governing body and its superintendent is subject to the following conditions:
        (1) If the superintendent holds a license under IC 20-28-5, the basic contract must be in the form of the regular teacher's contract.
        (2) The contract must be for a term of at least thirty-six (36) months.
        (3) Except as provided in subsection (b) or (c), the contract may be altered or rescinded for a new one at any time by mutual consent of the governing body and the superintendent. The consent of both parties must be in writing and must be expressed in a manner consistent with this section and sections 7 through 8 of this chapter.
        (4) If the superintendent holds a license under IC 20-28-5, the rights of a superintendent as a teacher under any other law are not affected by the contract.
     (b) This subsection applies to a contract entered into after June 30, 2013. The governing body may terminate a contract with a superintendent if the governing body provides the superintendent liquidated damages in an amount that equals the superintendent's current annual salary, including employer contributions to the

superintendent's retirement account under IC 5-10.4.
     (c) This subsection applies to a contract entered into after June 30, 2013. During the period beginning one (1) year before the expiration date of a superintendent's current contract and ending on the expiration date of the current contract, the parties may not mutually agree to increase the superintendent's salary, including employer contributions to the superintendent's retirement account under IC 5-10.4, in an amount that exceeds ten percent (10%) of the superintendent's current annual salary, including employer contributions to the superintendent's retirement account under IC 5-10.4, unless the parties agree to extend the term of the contract to a date at least one (1) year after the expiration date of the current contract.".
