Synopsis: Foundations. Creates the Indiana foundation coordination board to accept gifts, bequests, and devises on behalf of the state and foundations created to provide funding for state agencies and programs. Creates the Indiana foundation coordination board fund, and continually appropriates money in the fund to the board.

SENATE BILL No. 254



    A BILL FOR AN ACT to amend the Indiana Code concerning state offices and administration and to make an appropriation.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 4-12-15; (13)IN0254.1.1. -->     SECTION 1. IC 4-12-15 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]:
     Chapter 15. Indiana Foundation Coordination Board
    Sec. 1. As used in this chapter, "board" refers to the Indiana foundation coordination board created by section 5 of this chapter.
    Sec. 2. As used in this chapter, "fund" refers to the Indiana foundation coordination board fund established by section 10 of this chapter.
    Sec. 3. As used in this chapter, "program" means either of the following:
        (1) An activity performed by a state agency.
        (2) An activity that a state agency is authorized or required to perform by law.
    Sec. 4. As used in this chapter, "state agency" has the meaning set forth in IC 4-13-1-1(b).
    Sec. 5. The Indiana foundation coordination board is created to

coordinate and administer the fund.
    Sec. 6. The board consists of the following five (5) members:
        (1) The director of the budget agency or the director's designee.
        (2) The commissioner of the Indiana department of administration or the commissioner's designee.
        (3) The commissioner of the department of state revenue or the commissioner's designee.
        (4) The director of the state personnel department or the director's designee.
        (5) A member of the staff of the governor appointed by the governor.
    Sec. 7. Each member serves without compensation.

     Sec. 8. The director of the budget agency or the director's designee shall serve as chairperson of the board. The director of the budget agency may ask for advice or assistance from any state agency for the purposes of this chapter.
     Sec. 9. (a) The purposes of the board are:
        (1) to accept gifts, bequests, and devises of real and personal property to the state;
        (2) to:
            (A) accept gifts, bequests, and devises of real or personal property to a foundation created to further the programs of a state agency; and
            (B) transfer the real or personal property to the appropriate foundation;
        (3) to hold the fund in the name of the board;
        (4) to administer the fund;
        (5) to make all expenditures from the fund; and
        (6) to transfer money from the fund to:
            (A) any appropriate state fund or account; or
            (B) any appropriate foundation established by law to further the programs of a state agency.
    (b) The board shall:
        (1) determine the appropriate state agency, program, or foundation to receive each gift, bequest, or devise of real or personal property to the state; and
        (2) as soon as possible, transfer each gift, bequest, or devise of real or personal property to the state to the appropriate state agency, program, or foundation.
    (c) The board may:
        (1) sell property received through a gift, bequest, or devise to

the fund, the board, or the state; and
        (2) deposit the proceeds of the sale in the fund.
    (d) The board must comply with:
        (1) the terms and conditions of any gift, bequest, or devise; and
        (2) the provisions of IC 4-24-3 concerning the receipt and use of gifts, bequests, or devises.

     (e) The board shall meet at the call of the chairperson.
     Sec. 10. (a) The Indiana foundation coordination board fund is established. Expenditures from the fund may be made only to carry out the purposes of this chapter.
    (b) The fund consists of:
        (1) appropriations made by the general assembly;
        (2) gifts, bequests, and devises made to the state;
        (3) gifts, bequests, and devises made to a foundation created to further the programs of a state agency; and
        (4) proceeds of any property given or bequeathed to the state.
    (c) Gifts of money to the fund or the board or the proceeds from the sale of gifts donated to the fund or the board shall be deposited in the fund.
    (d) The treasurer of state shall invest the money in the fund not currently needed to meet the obligations of the fund in the same manner as other public money may be invested. Interest that accrues from these investments shall be deposited in the fund.
    (e) The expenses of administering this chapter shall be paid from money in the fund.
    (f) Money in the fund at the end of a state fiscal year remains in the fund and does not revert to any other fund. If the board is terminated, the money in the fund reverts to the state general fund.
    (g) Money in the fund is continually appropriated to the board for purposes of this chapter.
    Sec. 11. The board shall post information concerning:
        (1) the fund; and
        (2) all foundations created to assist any state agency;
on the Indiana transparency Internet web site.
