Synopsis: Insurance coverage of abortions. Prohibits a state employee health plan, an individual or group policy of accident and sickness insurance, and a group or individual contract with a health maintenance organization from including coverage for abortion unless the abortion is necessary to prevent a substantial permanent impairment of the life or physical health of the pregnant woman. Allows an insurer or health maintenance organization to offer a rider for abortion services if the insurer or health maintenance organization charges an additional premium for the rider.

    A BILL FOR AN ACT to amend the Indiana Code concerning insurance.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 5-10-8-16; (13)IN0335.1.1. -->     SECTION 1. IC 5-10-8-16 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 16. (a) As used in this section, "abortion" means the termination of human pregnancy with an intention other than to produce a live birth or to remove a dead fetus.
     (b) As used in this section, "state employee health plan" means a:
        (1) self-insurance program established under section 7(b) of this chapter; or
        (2) contract with a prepaid health care delivery plan that is entered into or renewed under section 7(c) of this chapter.
    (c) A state employee health plan may not provide coverage for abortion except for when the abortion is necessary to prevent a substantial permanent impairment of the life or physical health of the pregnant woman.

1, 2013]: Sec. 29. (a) As used in this section, "abortion" means the termination of human pregnancy with an intention other than to produce a live birth or to remove a dead fetus.
    (b) Except as provided in subsection (c), an individual or group policy or plan of accident and sickness insurance issued for delivery in Indiana may not
provide coverage for abortion except for when the abortion is necessary to prevent a substantial permanent impairment of the life or physical health of the pregnant woman.
     (c) An insurer of an individual group policy or plan of health and accident insurance may offer a rider for coverage of abortion services if the insurer charges an additional premium for the rider.
