Synopsis: Alternative education programs. Provides that the minimum length of the student instructional day applying to accredited public and nonpublic schools does not apply to an alternative education program. Requires an alternative education program to provide at least 250 minutes of instructional time each week. Requires the scheduling of at least two instructional periods each week during which a student participating in an alternative education program is required to meet with teachers. Authorizes the termination of a student's participation in an alternative education program if the student fails to attend at least 90% of the scheduled instructional periods. Provides that for school funding purposes, a school corporation that establishes an alternative education program or participates in an area alternative education program may include students in the alternative education program in the school corporation's: (1) average daily membership; (2) average daily attendance; and (3) additional pupil count.

    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

        (1) State tuition support (IC 21-3-1.7).
        (2) Distribution for transportation (IC 21-3-3.1).
        (3) Alternative education program grant (IC 21-3-11).
        (4) Average daily attendance flat grant (IC 21-3-4.5).
        (5) Vocational education grants (IC 21-3-1.8).

        (1) To receive the grant for alternative education programs under IC 21-3-11.
        (2) To be granted waivers from rules adopted by the state board that may otherwise interfere with the objectives of the alternative education program, including waivers of:
            (A) certain high school graduation requirements;
            (B) the length of the student instructional day as set forth in IC 20-10.1-2-1 (b);
            (C) (B) required curriculum and textbooks;
            (D) (C) teacher certification requirements; and
            (E) (D) physical facility requirements.

The minimum length of the student instructional day set forth in IC 20-10.1-2-1 (b) does not apply to an alternative education program established under this chapter.

(a) An alternative education program must provide each student with at least two hundred fifty (250) minutes of instructional time each week.
    (b) An alternative education program must require each student to schedule at least two (2) instructional periods each week during which the student is required to meet with the student's teachers.

A program organizer may terminate a student's participation in the alternative education program if the student fails to attend at least ninety percent (90%) of the student's scheduled instructional periods.

(a) For purposes of calculating a school corporation's state support, a school corporation that establishes an alternative education program

under section 3(a)(1) of this chapter may include a student participating in the alternative education program in the school corporation's:
        (1) average daily membership;
        (2) average daily attendance; and
        (3) additional pupil count.
    (b) For purposes of calculating a school corporation's state support, a school corporation that participates in an area alternative education program under section 3(a)(2) of this chapter may include a student participating in the alternative education program in the school corporation's:

        (1) average daily membership;
        (2) average daily attendance; and
        (3) additional pupil count.
