MR. SPEAKER:

    I move that House Bill 1181 be amended to read as follows:

SOURCE: Page 1, line 3; (01)MO118102.1. -->     Page 1, line 3, after "(a)" insert " This section does not:
        (1) affect the applicability of:
            (A) IC 24-1-1 through IC 24-1-4; or
            (B) any other law regulating trade or commerce other than a law regulating a public utility;
        (2) vest the commission with jurisdiction over complaints relating to:
            (A) unfair competition;
            (B) antitrust behavior; or
            (C) other marketplace activities alleged to be contrary to law;
        (3) vest the commission with primary jurisdiction over claims between two (2) or more parties arising under a contract or any other law; or
        (4) require a person subject to this section to exhaust the administrative remedies available through the commission before the person commences an action described in subdivision (3).
