    A BILL FOR AN ACT concerning transportation.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. [EFFECTIVE UPON PASSAGE] (a) As used in this SECTION, "soy diesel/bio diesel" refers to fuels (other than alcohol) that are primarily esters derived from biological materials, including oilseeds and animal fats, for use in compression and ignition engines.
    (b) The Indiana department of transportation (INDOT) shall conduct a study concerning the use of a soy diesel/bio diesel blend to fuel equipment owned or operated by the department.
    (c) The study required by this SECTION must do the following:
        (1) Provide an estimate of the number of gallons of:
            (A) diesel fuel;
            (B) soy diesel/bio diesel fuel; and
            (C) gasoline;
        used by the department for vehicles, generators, motors, tractors, and other equipment during calendar year 2000.
        (2) Provide an estimate of the average price per gallon paid for each of the fuels listed under subdivision (1).
        (3) Examine the availability, as of the date of the report

required under subsection (d), of soy diesel/bio diesel fuel at INDOT facilities throughout the state.
        (4) Examine any special fuel storage or fuel handling issues associated with the use of soy diesel/bio diesel fuel by INDOT.
        (5) Examine the performance, fuel economy, and maintenance records of INDOT equipment that used soy diesel/bio diesel fuel during calendar year 2000.
        (6) Examine any studies that have been made concerning the environmental benefits or costs associated with the use of soy diesel/bio diesel fuel.
        (7) Examine the extent to which the ten percent (10%) state purchasing preference for soy diesel/bio diesel fuel under IC 5-22-15-19 has been used by INDOT.
        (8) Examine any other information concerning the advisability of requiring INDOT and other state agencies to use soy diesel/bio diesel fuel whenever possible.
    (d) INDOT shall submit a written report concerning the study required by this SECTION to the legislative council and the governor not later than October 1, 2001.

    SECTION 2. An emergency is declared for this act.
