A BILL FOR AN ACT to amend the Indiana Code concerning
professions and occupations.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 25-8-4-19 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 19. The board shall
renew a license if the license holder:
(1) pays the fee set forth in IC 25-8-13 to renew the license before
the license is to expire; and
(2) unless exempt under IC 25-8-15-1(a), fulfills the continuing
education requirements under IC 25-8-15.

SECTION 2. IC 25-8-15-1 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 1. (a)
A person who
held a valid license as a cosmetologist on August 1, 1996, is exempt
from the continuing education requirement in subsection (b).
(b) Except as provided
in subsection (a), in
section 9 of this
chapter, and in IC 25-8-16, a cosmetology professional shall complete
sixteen (16) hours of continuing education before the end of each
license renewal period that begins after August 1, 1996.
(b) (c) A person who holds more than one (1) license under this
article does not have to complete more continuing education hours than
are required for one (1) license.

SECTION 3. IC 25-8-15-8 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2001]: Sec. 8. (a) Except as
provided in sections 1 and 9 of this chapter, the board may not renew
the license of a cosmetology professional who fails to comply with the
continuing education requirements of this chapter.
(b) If a cosmetology professional who is not exempt under section
1(a) of this chapter fails to provide the board with proof of compliance
with the continuing education requirements of this chapter, the board
shall notify the cosmetology professional in writing that the application
for renewal is incomplete. The board may not renew the license until
the board receives satisfactory proof of completion of the applicable
continuing education requirements.

SECTION 4. [EFFECTIVE JULY 1, 2001]
(a) If, after July 31,
1996, and before July 1, 2001, the board has not renewed the
license of a cosmetologist who held a valid license on August 1,
1996, solely because the cosmetologist failed to comply with the
continuing education requirements of this chapter, the board shall:
(1) waive the continuing education requirements for; and
(2) renew the license of;
the cosmetologist.
(b) This SECTION expires on January 1, 2002.
