A BILL FOR AN ACT to amend the Indiana Code concerning
health and to make an appropriation.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1.

IS ADDED TO THE INDIANA CODE
AS A
NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
JULY 1, 2001]:
Chapter 12. Health Entitlement Fund
Sec. 1. (a) The health entitlement fund is established for the
purpose of distributing additional money to each local board of
health and each city health department in Indiana. The fund shall
be administered by the state department and consists of
appropriations by the general assembly.
(b) The expenses of administering the fund shall be paid from
money in the fund.
(c) The treasurer of state shall invest the money in the fund not
currently needed to meet the obligations of the fund in the same
manner as other public funds may be invested. Interest that
accrues from these investments shall be deposited in the fund.
(d) Money in the fund at the end of a state fiscal year does not
revert to the state general fund.
Sec. 2. There is annually appropriated to the health entitlement
fund established under section 1 of this chapter thirty million
eighty thousand dollars ($30,080,000) from the state general fund
to carry out the purposes of this chapter.
Sec. 3. (a) The state department shall annually distribute one
hundred sixty thousand dollars ($160,000) to each local board of
health and each city health department in Indiana.
(b) The state department shall make the distributions required
under subsection (a) from money in the health entitlement fund.
Sec. 4. (a) Each city shall establish a city health fund for the
deposit of the distribution received under section 3 of this chapter.
(b) Money in the city health fund may only be used for the
following purposes:
(1) The provision of state mandated services.
(2) The performance of state mandated inspections.
(3) Expansion of the city's environmental health services,
including the provision of assistance to the department of
environmental management.
(4) Increasing food inspections and food borne disease
investigations.
(5) Epidemiology.
(6) Disease surveillance.
(7) Disaster preparations for acts of bioterrorism.
(8) Health education.
(9) Smoking cessation clinics.
(10) Continuing education for city health department
employees.
(11) Disease control and prevention programs for the
following:
(A) Sexually transmitted diseases and human
immunodeficiency virus (HIV) infection.
(B) Diabetes.
(C) Cancer.
(D) Coronary disease.
(E) Other acute and chronic illnesses.
(12) Nutrition education.
(13) Child health services.
(14) Nursing services, including the following:
(A) Disease surveillance.
(B) Patient follow-up.
(C) Health screening.
(D) Behavioral education and counseling.
(E) Home visits.
(F) Other assistance to the impaired and mentally ill.
(15) Data collection.
(16) Administrative services, including the following:
(A) Grant development.
(B) Contract negotiations.
(C) Program development.
(D) Equipment.
(E) Training.
(F) Research.
Sec. 5. (a) A local board of health shall deposit a distribution
received under section 3 of this chapter in the county health fund
established under
IC 16-20-2.
(b) Money deposited in the county health fund under this section
may only be used for the following purposes:
(1) The provision of state mandated services.
(2) The performance of state mandated inspections.
(3) Expansion of the county's environmental health services,
including the provision of assistance to the department of
environmental management.
(4) Increasing food inspections and food borne disease
investigations.
(5) Epidemiology.
(6) Disease surveillance.
(7) Disaster preparations for acts of bioterrorism.
(8) Health education.
(9) Smoking cessation clinics.
(10) Continuing education for county health department
employees.
(11) Disease control and prevention programs for the
following:
(A) Sexually transmitted diseases and human
immunodeficiency virus (HIV) infection.

(c) Money deposited into the county health fund under this
section may not be used to reduce the amount levied for the county
health fund under
IC 16-20-2-17.
Sec. 6. The handling and expenditure of money distributed to a
local board of health or a city health department under section 3
of this chapter is subject to audit and supervision by the state
board of accounts. The state board of accounts shall provide a copy
of each audit to the state health commissioner.
