COMMITTEE REPORT

    Mr. President: Pursuant to Joint Rule 20, your Committee on Rules and Legislative Procedure, to which was referred Engrossed House Bill 2145 because it conflicts with HEA 1855-2001 without properly recognizing the existence of HEA 1855-2001, has had Engrossed House Bill 2145 under consideration and begs leave to report back to the Senate with the recommendation that Engrossed House Bill 2145 be corrected as follows:


    Page 18, line 3, delete "P.L.188-1999," and insert "HEA 1855-2001, SECTION 6,".
    Page 18, line 4, delete "SECTION 8,".
    Page 18, line 30, after "weapon" insert "or battery causing death".
    Page 19, delete lines 7 through 11, begin a new line double block indented and insert:
            "(O) dealing in cocaine, a narcotic drug, or methamphetamine (IC 35-48-4-1) if the court finds the person possessed a firearm (as defined in IC 35-47-1-5) at the time of the offense, or the person delivered or intended to deliver to a person under eighteen (18) years of age at least three (3) years junior to the person and was on a school bus or within one thousand (1,000) feet of:
                (i) school property;
                (ii) a public park;
                (iii) a family housing complex; or
                (iv) a youth program center;
            (P) dealing in a schedule I, II, or III controlled substance (IC 35-48-4-2) if the court finds the person possessed a firearm (as defined in IC 35-47-1-5) at the

time of the offense, or the person delivered or intended to deliver to a person under eighteen (18) years of age at least three (3) years junior to the person and was on a school bus or within one thousand (1,000) feet of:
                (i) school property;
                (ii) a public park;
                (iii) a family housing complex; or
                (iv) a youth program center;".
