Synopsis: Closed captioning. Creates the closed captioning council. Requires the council: (1) to coordinate closed captioning services for video and television programmers; and (2) to advise television stations, cable television companies, and government agencies on regulations regarding closed captioning and on closed captioning technology.

    A BILL FOR AN ACT to amend the Indiana Code concerning human services.

Be it enacted by the General Assembly of the State of Indiana:

    SECTION 1. IC 12-7-2-44 , AS AMENDED BY P.L.287-2001, SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2002]: Sec. 44. "Council" means the following:
        (1) For purposes of IC 12-9-4 , the meaning set forth in IC 12-9-4-1.
        (2) For purposes of IC 12-12-9 , the meaning set forth in IC 12-12-9-1.
         (3) For purposes of IC 12-13-4 , the meaning set forth in IC 12-13-4-1.
        (3) (4) For purposes of IC 12-15-41 and IC 12-15-42 , the Medicaid work incentives council established by IC 12-15-42-1.
        (4) (5) For purposes of IC 12-17-15 , the meaning set forth in IC 12-17-15-2.
        (5) (6) For purposes of IC 12-18-3 and IC 12-18-4 , the domestic violence prevention and treatment council established by IC 12-18-3-1.
        (6) (7) For purposes of IC 12-21-4 , the meaning set forth in

IC 12-21-4-1.
        (7) (8) For purposes of IC 12-28-5 , the meaning set forth in IC 12-28-5-1.
    SECTION 2. IC 12-7-2-196 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2002]: Sec. 196. "Unit" means the following:
         (1) For purposes of IC 12-12-7 , has the meaning set forth in IC 12-12-7-1.
         (2) For purposes of IC 12-12-9 , the meaning set forth in IC 12-12-9-2.
    SECTION 3. IC 12-12-9 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2002]:
     Chapter 9. Closed Captioning Council
     Sec. 1. As used in this chapter, "council" refers to the closed captioning council established by section 3 of this chapter.
     Sec. 2. As used in this chapter, "unit" refers to the unit of services for the deaf and hard of hearing established by IC 12-12-1-2.
     Sec. 3. (a) The closed captioning council is established.
    (b) The council shall do the following:
        (1) Coordinate closed captioning services for video and television programmers.
        (2) Advise television stations, cable television companies, and local and state government agencies on regulations regarding closed captioning and closed captioning technology.

         (3) Make recommendations to the unit for action.
     Sec. 4. The council consists of eleven (11) members appointed by the governor as follows:
        (1) A representative of the deaf community.
        (2) A representative of the hard of hearing community.
        (3) An individual who is employed by a company or organization that provides rehabilitative services for deaf and blind individuals.
        (4) An individual who is a member of the Independent Living Council.
        (5) Four (4) individuals employed in the video or television industry.
        (6) An individual who is employed by the state emergency management agency.
        (7) An individual who is employed by an educational institution where hearing impaired students are enrolled.


        (8) An individual who is a member of the governor's planning council on people with disabilities.
     Sec. 5. (a) A member of the council serves a term of three (3) years.
    (b) A member may not serve more than two (2) consecutive terms.

    Sec. 6. The director of the unit shall serve as the chairperson of the council.
     Sec. 7. The unit shall provide staff and administrative support to the council.
     Sec. 8. The expenses of funding the council shall be paid solely from the unit's budget.
     Sec. 9. The governor shall fill a vacancy on the council by appointing an individual to serve the remainder of the unexpired term.
     Sec. 10. The council shall hold at least three (3) public hearings each year upon the call of the chairperson. At least one (1) hearing each year must be held in:
        (1) northern Indiana;
        (2) central Indiana; and
        (3) southern Indiana.

     Sec. 11. Each member of the council who is not an employee of the state or a political subdivision is entitled to the following:
        (1) The minimum salary per diem provided by IC 4-10-11-2.1(b).
        (2) Reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in the state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    Sec. 12. Each member of the council who is a state employee is entitled to reimbursement for traveling expenses as provided under IC 4-13-1-4 and other expenses actually incurred in connection with the member's duties as provided in state policies and procedures established by the Indiana department of administration and approved by the budget agency.
    Sec. 13. The affirmative votes of a majority of the voting members appointed to the council are required for the council to take action on any measure, including final reports.
