Citations Affected: IC 15-4.

Synopsis: Seed contracts. Conference committee report for EHB 1119. Provides that a seed supplier may not enter real property owned or occupied by a farmer unless certain conditions are satisfied. Provides a cause of action to a farmer against a seed supplier if the supplier wrongfully enters the real property owned or occupied by the farmer. (This conference committee report does the following: (1) Changes the definition of "production contract" to exclude contracts under which the seed supplier retains title only to the seed. (2) Changes the definition of "seed supplier" to include a person engaged in commercial production or supply of seed. (3) Changes the effective date of the bill to January 1, 2003.)

Effective: January 1, 2003.



CONFERENCE COMMITTEE REPORT

MR. PRESIDENT:
    Your Conference Committee appointed to confer with a like committee from the House upon Engrossed Senate Amendments to Engrossed House Bill No. 1119 respectfully reports that said two committees have conferred and agreed as follows to wit:

    that the House recede from its dissent from all Senate amendments and that the House now concur in all Senate amendments to the bill and that the bill be further amended as follows:

    Replace the effective date in SECTION 1 with "[EFFECTIVE JANUARY 1, 2003]".
