Synopsis: State prescription drug buying pool. Requires the office of the secretary of family and social services to establish, implement, and maintain a prescription drug purchasing program (program) to negotiate the costs of prescription drugs for the following groups who may participate in the program: (1) a state agency that purchases prescription drugs or that arranges for the payment of the purchase of prescription drugs; (2) a local unit; or (3) a state educational institution. Specifies that if the state personnel department participates in the program, the self-insurance program or contract must provide for payment for prescription drugs purchased through the prescription drug purchasing program.

    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 12-8-15; (03)HB1567.1.1. -->     SECTION 1. IC 12-8-15 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2003]:
     Chapter 15. Prescription Drug Purchasing Program
    Sec. 1. (a) The office of the secretary of family and social services shall establish, implement, and maintain a prescription drug purchasing program to negotiate the terms related to the purchase of prescription drugs by a person described in section 2 of this chapter.
    (b) The office may contract with a pharmacy benefit manager to conduct the negotiations required under subsection (a).
    Sec. 2. The following persons may participate in the prescription drug purchasing program established in section 1 of this chapter:
        (1) A state agency:
            (A) that purchases prescription drugs; or
            (B) that arranges for the payment of the purchase of prescription drugs.
        (2) A local unit (as defined in IC 5-10-8-1 ).
        (3) A state educational institution (as defined in IC 20-12-0.5-1 ).
    Sec. 3. If the state personnel department participates in the prescription drug purchasing program established by section 1 of this chapter and:
        (1) establishes a self-insurance program under IC 5-10-8-7 (b); or
        (2) enters into a contract for health services through one (1) or more prepaid health care delivery plans under IC 5-10-8-7 (c);
that provides coverage for prescription drugs, the self-insurance program or contract must provide for payment for prescription drugs purchased through the prescription drug purchasing program.
    Sec. 4. The office may adopt rules under IC 4-22-2 to implement this chapter.
