    A BILL FOR AN ACT to amend the Indiana Code concerning education.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 20-5-2-2.5; (03)IN1129.1.1. -->     SECTION 1. IC 20-5-2-2.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2003]: Sec. 2.5. After June 30, 2003, the governing body of a school corporation may not enter into a contract for or allow the sale of:
        (1) soft drinks and similar beverages; and
        (2) food;
with no or low nutritional value, as defined by the United States Department of Agriculture, from vending machines or other dispensing units during school hours in areas of school grounds or buildings to which students have access.

SOURCE: ; (03)IN1129.1.2. -->     SECTION 2. [EFFECTIVE JULY 1, 2003] IC 20-5-2-2.5 , as added by this act, does not apply to a contract that was executed before July 1, 2003, and that is in existence on July 1, 2003, that requires a governing body to allow the sale of:
        (1) soft drinks and similar beverages; and
        (2) food;
with no or low nutritional value, as defined by the United States Department of Agriculture, from vending machines or other dispensing units during school hours. However, the governing body may not renew a contract described in this SECTION and, after the contract expires, must comply with IC 20-5-2-2.5 , as added by this act.
