Synopsis: Surveillance of public health threats. Allows: (1) the state
department of health to collect information concerning syndromes
related to bioterrorism and other public health threats; and (2) the
information to be used for counterterrorism purposes. Requires
accredited schools or school corporations to report each day the
number of students who are absent.

A BILL FOR AN ACT to amend the Indiana Code concerning
health.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 16-41-2-1 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2004]: Sec. 1. The state department
may adopt rules under IC 4-22-2 that do the following:
(1) Define and classify the following:
(A) Communicable diseases.
(B) Syndromes and symptoms concerning bioterrorism,
related outbreaks of infectious disease, and public health
threats and emergencies determined by the state
department to warrant further investigation.
(C) Other diseases that are a danger to health based upon the
characteristics of the disease.
(2) Establish reporting, monitoring, and preventive procedures for
communicable diseases, bioterrorism, related outbreaks of
infectious disease, and public health threats and emergencies.
Information collected under this subdivision may be used for
counterterrorism purposes.

SECTION 2. IC 16-41-2-2 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2004]: Sec. 2. Each:
(1) licensed physician;
(2) administrator of a hospital licensed under IC 16-21-2 or the
administrator's representative; or
(3) director of a medical laboratory or the director's
representative; or
(4) health care provider or other organization or entity that
collects data and information concerning bioterrorism,
related outbreaks of infectious disease, or public health
threats and emergencies;
shall report to the local or state health officer designated by the state
department the information required to be reported by the rules adopted
under section 1 of this chapter.

SECTION 3. IC 20-8.1-13-1 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2004]: Sec. 1. (a) A school
corporation may develop and implement a system of notifying the
parent or guardian of a student when:
(1) the student fails to attend school; and
(2) the student does not have an excused absence for that day.
(b) An accredited school (described in IC 20-1-1-6(a)(5)) or a
school corporation shall report daily the number of students who
are absent each school day using the reporting mechanism
developed and implemented by the state department of health.

SECTION 4. IC 20-8.1-13-2 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2004]: Sec. 2. If a school
corporation implements a notification system under
section 1(a) of this
chapter, the attendance officer or the attendance officer's designee shall
make a reasonable effort to contact by telephone the parent or guardian
of each student who has failed to attend school and does not have an
excused absence for that day.
