I move that House Bill 1190 be amended to read as follows:

Page 3, between lines 35 and 36, begin a new paragraph and insert:

"SECTION 6. IC 7.1-3-12-8 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2006]: Sec. 8. (a) For purposes of this section,
"permit" means a farm winery wholesaler permit issued under this
section.
(b) The commission may issue a one (1) year permit to:
(1) an individual; or
(2) a partnership, limited liability company, or corporation
domiciled in or admitted to do business in Indiana;
that holds a farm winery permit under IC 7.1-3-12-3.
(c) The commission shall charge an annual fee of five hundred
dollars ($500) for each permit issued under this section.
(d) The holder of a permit may sell only wine produced on a
farm winery owned by the permit holder.
(e) The holder of a permit under this section may sell wine
directly to the holder of a retailer permit in an amount not to
exceed:
(1) two thousand five hundred (2,500) cases per year; and
(2) fifty (50) cases to the holder of a retailer permit in any one
(1) month.
(f) The holder of a permit shall provide the commission, law
enforcement agencies, and state taxing authorities with information
on the:
(1) quantity and destination of wine shipped to a consumer by
the permit holder;
(2) identity of individuals to whom the wine is shipped; and
(3) purchases by consumers.".
