Synopsis: State fair commission. Authorizes the chairman of the state fair advisory committee or a member of the committee designated by the chairman to serve as an ex officio nonvoting member of the state fair commission (commission). Provides that the term of: (1) certain members of the commission begins October 1 and expires September 30 of the fourth year following the appointment; and (2) a member currently serving on the commission is extended for an additional three months. Specifies that a legislative member of the commission is entitled to receive the per diem, mileage, and travel allowances established by the legislative council and paid to members of the general assembly serving on interim study committees. (The introduced version of this bill was prepared by the state fair advisory committee.)

    A BILL FOR AN ACT to amend the Indiana Code concerning agriculture and animals.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 15-1.5-2-2; (06)HB1022.1.1. -->     SECTION 1. IC 15-1.5-2-2, AS AMENDED BY P.L.241-2005, SECTION 9, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 2. (a) The commission consists of eight (8) nine (9) members as follows:
        (1) Five (5) members appointed by the governor.
        (2) The presiding officer of the board.
        (3) The commissioner of agriculture lieutenant governor or the commissioner's lieutenant governor's designee.
        (4) The presiding officer of the trustees or the presiding officer's designee who must be selected from the membership of the trustees.
         (5) The director of the department of agriculture or the director's designee.
     (b) The chairman of the state fair advisory committee appointed under IC 15-1-1.5-5(c) or a member of the state fair advisory committee designated by the chairman may serve as an ex officio nonvoting member of the commission.
    (c) A legislative member of the commission is entitled to receive the same per diem, mileage, and travel allowances established by the legislative council and paid to members of the general assembly serving on interim study committees. Per diem, mileage, and travel allowances paid under this subsection shall be paid from appropriations made to the legislative council or the legislative services agency.

    (b) (d) Not more than one (1) member appointed under subsection (a)(1) may reside in the same district. Each district is not required to have a member of the commission represent it.
    (c) (e) Not more than three (3) members appointed under subsection (a)(1) may be affiliated with the same political party.
    (d) (f) Two (2) members appointed under subsection (a)(1) must have a recognized interest in agriculture or agribusiness.
SOURCE: IC 15-1.5-2-3; (06)HB1022.1.2. -->     SECTION 2. IC 15-1.5-2-3 IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 3. (a) Except as provided in subsection (d), the term of an individual appointed under section 2(a)(1) of this chapter begins on the later of the following:
        (1) July October 1 after the expiration of the term of the member whom the individual is appointed to succeed.
        (2) The day the individual is appointed by the governor.
    (b) The term of a member appointed under section 2(a)(1) of this chapter expires on June September 30 of the fourth year after the expiration of the term of the member's immediate predecessor.
    (c) Except as provided in subsection (d), the governor may reappoint a member appointed under section 2(a)(1) of this chapter for a new term. A member reappointed by the governor is the member's own:
        (1) successor for purposes of subsection (a); and
        (2) immediate predecessor for purposes of subsection (b).
    (d) An individual may not serve as a member under section 2(a)(1) of this chapter for more than eight (8) years in any twelve (12) year period.
    (e) The member serving under section 2(a)(2) of this chapter serves until the member is not the presiding officer of the board.

    (b) As used in this SECTION, "member" refers to a member of the commission.
    (c) Notwithstanding IC 15-1.5-2-3, as amended by this act, a member:
        (1) who is serving on the commission on June 30, 2006; and
        (2) whose term of service on the commission expires June 30, 2006;
is entitled to serve on the commission through September 30, 2006.

     (d) Notwithstanding IC 15-1.5-2-3, as amended by this act, a member:
        (1) who is serving on the commission on June 30, 2006; and
        (2) whose term of service on the commission expires after June 30, 2006;
is entitled to serve on the commission through September 30 of the year that the term of the member expires.

     (e) This SECTIONl expires October 1, 2009.
