Synopsis: Preparing documents for recording. Provides that an individual who created a document or an individual who submits a document for recording (if the individual who created the document cannot be located) shall affirm that the individual reviewed the document and redacted all Social Security numbers in the document.

    A BILL FOR AN ACT to amend the Indiana Code concerning local government.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 36-2-7.5-5; (06)IN0313.1.1. -->     SECTION 1. IC 36-2-7.5-5, AS ADDED BY P.L.91-2005, SECTION 3, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE UPON PASSAGE]: Sec. 5. (a) If a document is submitted for recording, an affirmation that:
        (1) meets the requirements of subsection (b) or (c) whichever applies; and
        (2) is included on a form prescribed by the state board of accounts;

must be recorded with the document.
    (a) (b) An individual preparing who creates a document for recording, shall affirm, under the penalties for perjury, that the individual has:
        (1) reviewed the entire document before submitting the document for recording for the purpose of identifying and, to the extent permitted by law, redacting all Social Security numbers; and
        (2) taken reasonable care to redact each Social Security number in the document.
    (c) If the individual who created a document for recording cannot be located through the exercise of reasonable care, the individual submitting the document for recording shall affirm, under penalties for perjury, that the individual has:
        (1) reviewed the entire document before submitting the document for recording for the purpose of identifying
and, to the extent allowed by law, redacting all Social Security numbers; and
        (2) exercised reasonable care to redact each Social Security number in the document.

    (b) An individual shall make the affirmation required under subsection (a) on a form prescribed by the state board of accounts.
