Synopsis: Health facility fire sprinklers and smoke alarms. Requires a health facility to have: (1) an automatic fire sprinkler system throughout the facility before July 1, 2011; and (2) an automatic fire detection system that meets specified requirements before July 1, 2008. Requires the state department of health to publish the types of sprinkler systems and smoke detectors in each health facility in the department's consumer guide to nursing homes.

    A BILL FOR AN ACT to amend the Indiana Code concerning health.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 16-28-11-5; (06)IN0335.1.1. -->     SECTION 1. IC 16-28-11-5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2006]: Sec. 5. (a) A health facility that is licensed under this article as a comprehensive care facility must have the following:
        (1) An automatic fire sprinkler system throughout the facility not later than July 1, 2011.
        (2) An automatic fire detection system that:
            (A) provides a visual display on the corridor side of each resident's room;
            (B) provides an audible and visual alarm at the nurse's station that attends each room; and
            (C) transmits to a central station service;
        not later than July 1, 2008.
    (b) The state department, in consultation with the fire prevention and building safety commission, shall adopt rules under IC 4-22-2 to implement this section.

department of health shall disclose the following information in the department's consumer guide to nursing homes:
        (1) Through June 30, 2008, whether a health facility has:
            (A) battery operated;
            (B) hard wired; or
            (C) no;
        smoke detectors in each resident's room.
        (2) Through June 30, 2011, whether a health facility is:
            (A) fully;
            (B) partially; or
            (C) not;
        equipped with sprinklers.
    (b) This SECTION expires December 31, 2011.
