A BILL FOR AN ACT to amend the Indiana Code concerning
criminal law and procedure.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 5-2-4-6 IS AMENDED TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2007]: Sec. 6. Criminal intelligence information
is hereby declared confidential and may be disseminated only to
another criminal justice agency, in accordance with section 7 of this
chapter, and only if the agency making the dissemination is satisfied
that the need to know and intended uses of the information are
reasonable and that the confidentiality of the information will be
maintained.

SECTION 2. IC 5-2-4-7 IS AMENDED TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2007]: Sec. 7.
(a) Except as provided in
subsection (b), a person who knowingly releases criminal intelligence
information to an agency or person other than a criminal justice agency
commits a Class A misdemeanor.
(b) A criminal justice agency may disseminate an assessment of
criminal intelligence information to a government official or any
other individual when necessary to avoid imminent danger to life
or property.
