  | DIGEST OF INTRODUCED BILL Death penalty. Requires the state to seek a death sentence if a defendant murdered a person less than 18 years of age and the defendant intentionally killed the victim while committing or attempting to commit: (1) child molesting; (2) criminal deviate conduct; (3) kidnapping; (4) rape; or (5) criminal confinement. Allows the state to seek a death sentence or sentence of life imprisonment for a person who commits murder while committing or attempting to commit criminal confinement. |
