MR. SPEAKER:
    Your Committee on       Education     , to which was referred       House Bill 1088     , has had the same under consideration and begs leave to report the same back to the House with the recommendation that said bill be amended as follows:

    Delete the title and insert the following:
    A BILL FOR AN ACT to amend the Indiana Code concerning education and to make an appropriation.
    Delete everything after the enacting clause and insert the following:

SOURCE: ; (08)AM108801.1. -->     SECTION 1. [EFFECTIVE JULY 1, 2007 (RETROACTIVE)] (a) The appropriation made by P.L.224-2007 to the department of education for testing and remediation for:
        (1) the state fiscal year beginning July 1, 2007, and ending June 30, 2008; and
        (2) the state fiscal year beginning July 1, 2008, and ending June 30 2009;
is voided.

     (b) There is appropriated to the department of education twenty-four million seven hundred thousand dollars ($24,700,000)

from the state general fund for student testing for the state fiscal year beginning July 1, 2007, and ending June 30, 2008.
    (c) There is appropriated to the department of education twenty-four million seven hundred thousand dollars ($24,700,000) from the state general fund for student testing for the state fiscal year beginning July 1, 2008, and ending June 30, 2009.
    (d) There is appropriated to the department of education sixteen million three hundred thousand dollars ($16,300,000) from the state general fund for student remediation for the state fiscal year beginning July 1, 2007, and ending June 30, 2008.
    (e) There is appropriated to the department of education sixteen million three hundred thousand dollars ($16,300,000) from the state general fund for student remediation for the state fiscal year beginning July 1, 2008, and ending June 30, 2009.
    (f) The appropriations for remediation in subsections (d) and (e) shall be used by school corporations to provide remediation programs for students who attend public and nonpublic schools. For purposes of tuition support, these students are not to be counted in the average daily membership.

     (g) This SECTION expires July 1, 2009.
