HOUSE BILL No. 1078



    A BILL FOR AN ACT to amend the Indiana Code concerning state offices and administration.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 4-20.5-7-20; (09)IN1078.1.1. -->     SECTION 1. IC 4-20.5-7-20 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2009]: Sec. 20. (a) As used in this section, "grantee" refers to the Heart of Madison Habitat for Humanity.
    (b) As used in this section, "real property" refers to a tract of land containing approximately four (4) acres located in the city of Madison, Indiana, under the control of the Indiana department of transportation. The real property is part of a larger tract of land bounded by the following streets in the city of Madison:
        (1) Lanham Street on the east.
        (2) Green Road on the south.
        (3) Maple Street on the west.
        (4) Pinehurst Avenue and Lanier Drive on the north.
    (c) The governor and the commissioner are authorized and directed on behalf of and in the name of the state of Indiana to convey the real estate to the grantee. Except as provided in this section, the conveyance of the real estate shall be made without

consideration.
    (d) Conveyance of the real estate is subject to highways, easements, and restrictions of record.
    (e) Before the conveyance is completed, the following must occur:
        (1) The department shall provide for an environmental audit to be conducted by a competent person.
        (2) If the environmental audit required by subdivision (1) discloses that environmental remediation is required, the Indiana department of transportation shall provide and pay for the remediation. The Indiana department of transportation shall also pay for the cost of the environmental audit.
    (f) Except as provided in this section, the conveyance of the real estate must comply with this chapter. The department shall have a quitclaim deed prepared to convey the real estate to the grantee. The deed must state the conditions and restrictions contained in subsection (d). The commissioner and the governor shall sign the deed, and the seal of the state shall be affixed to the deed.
    (g) The grantee shall have the deed to the real estate recorded in Jefferson County, Indiana.
    (h) This section expires July 1, 2015.
