Synopsis: Lake County courts. Establishes the Lake County judicial center fund (fund) for the purpose of financing, constructing, and equipping a Lake County judicial center and related buildings and parking facilities, including paying for costs related to the demolition or renovation of existing buildings and the acquisition of land. Establishes a $10 Lake County judicial center fee (fee) to be collected in each action: (1) filed in the Lake circuit court or superior court of Lake County; or (2) in which a person is convicted of an offense, required to pay a pretrial diversion fee, found to have committed an infraction, or found to have violated an ordinance. Requires the fee to be deposited in the fund. Makes an appropriation.

HOUSE BILL No. 1435



    A BILL FOR AN ACT to amend the Indiana Code concerning courts and court officers and to make an appropriation.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 33-33-45-46; (09)IN1435.1.1. -->     SECTION 1. IC 33-33-45-46 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2009]: Sec. 46. (a) In each action:
        (1) filed in the:
            (A) Lake circuit court; or
            (B) superior court of Lake County; or
        (2) in which a person is:
            (A) convicted of an offense;
            (B) required to pay a pretrial diversion fee;
            (C) found to have committed an infraction; or
            (D) found to have violated an ordinance;
        by the Lake circuit court or superior court of Lake County;
the clerk of the Lake circuit court shall collect a Lake County judicial center fee of ten dollars ($10).
    (b) Fees collected under this section shall be deposited in the Lake County judicial center fund established by section 47 of this chapter.

SOURCE: IC 33-33-45-47; (09)IN1435.1.2. -->     SECTION 2. IC 33-33-45-47 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2009]: Sec. 47. (a) The Lake County judicial center fund is established for the purpose of financing, constructing, and equipping a Lake County judicial center and related buildings and parking facilities, including paying for costs related to the demolition or renovation of existing buildings and the acquisition of land. The fund shall be administered by the Lake County council.
    (b) The fund consists of the following:
        (1) Fees collected under section 46 of this chapter.
        (2) Appropriations to the fund from the general assembly.
        (3) Grants, gifts, and donations intended for deposit in the fund.
        (4) Interest that accrues from money in the fund.
    (c) The expenses of administering the fund shall be paid from money in the fund.
    (d) The treasurer of state shall invest the money in the fund not currently needed to meet the obligations of the fund in the same manner as other public money may be invested. Interest that accrues from these investments shall be deposited in the fund.
    (e) Money in the fund at the end of a state fiscal year does not revert to the state general fund.

     (f) Money in the fund is continuously appropriated to carry out the purposes of the fund.
