Synopsis: Funding for fatality review teams. Requires the state
department of health to charge a child fatality review fee of $2 for each
search of the records for a death certificate and deposit the fee in the
child fatality review fund. Establishes the child fatality review fund to
defray expenses incurred by the statewide child fatality review
committee and make grants to local child fatality review teams.
Requires the department of child services to establish and administer
a grant program for local child fatality review teams. Makes an
appropriation.
Effective: July 1, 2009.

A BILL FOR AN ACT to amend the Indiana Code concerning
family law and juvenile law and to make an appropriation.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 16-37-1-11.5 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2009]: Sec. 11.5. (a) In addition to
the fee charged by the state department under section 11 of this chapter
for a search of the records in the division of vital records, the state
department shall charge a birth problems registry fee of two dollars
($2) for each search of the records for a birth certificate. The fees
collected under this section subsection shall be deposited in the birth
problems registry fund established by IC 16-38-4-17.
(b) In addition to the fees charged by the state department
under section 11 of this chapter for a search of the records in the
division of vital records, the state department shall charge a child
fatality review fee of two dollars ($2) for each search of the records
for a death certificate. The fees collected under this subsection
shall be deposited in the child fatality review fund established by
IC 31-33-25-17.

SECTION 2. IC 31-33-25-15, AS ADDED BY P.L.145-2006,
SECTION 288, IS AMENDED TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2009]: Sec. 15. The expenses of the statewide
child fatality review committee shall be paid from:
(1) the child fatality review fund established under section 17
of this chapter; and
(2) any other funds appropriated to the department.

SECTION 3. IC 31-33-25-17 IS ADDED TO THE INDIANA
CODE AS A NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2009]: Sec. 17. (a) The child fatality review
fund is established for the following purposes:
(1) Defraying expenses incurred by the statewide child fatality
review committee.
(2) Making grants to local child fatality review teams
established under IC 31-33-24.
(b) The fund shall be administered by the department.
(c) The fund consists of:
(1) fees deposited into the fund under IC 16-37-1-11.5(b); and
(2) money appropriated to the fund by the general assembly.
(d) The expenses of administering the fund shall be paid from
money in the fund.
(e) At least fifty percent (50%) of the money in the fund must be
used to provide grants under section 18 of this chapter.
(f) Money in the fund at the end of a particular fiscal year does
not revert to the state general fund.
(g) Money in the fund is annually appropriated for the purposes
of the fund.

SECTION 4. IC 31-33-25-18 IS ADDED TO THE INDIANA
CODE AS A
NEW SECTION TO READ AS FOLLOWS
[EFFECTIVE JULY 1, 2009]:
Sec. 18. The department shall
establish a grant program to provide financial support to local
child fatality review teams established under IC 31-33-24. A local
child fatality review team may apply for a grant under this section
on a form prescribed by the department. The department may
award a grant to any local child fatality review team that satisfies
the criteria established by the department.
